By accessing or using Digital Polygraph (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
These Terms apply to each paid calculation session and to the resulting PDF Engineering Estimation Report.
Digital Polygraph is a deterministic software engineering calculation platform. It models release feasibility for a software product or milestone by calculating engineering effort, estimated duration, team allocation, development stages, maturity checkpoints, and delivery scenarios based on parameters entered by the user.
The Service operates as an automated calculation tool. With the same user inputs and the same calculation model configuration, the system generates the same calculated result.
Digital Polygraph is not a human consulting service and does not include personal review, custom advisory work, methodology debate, project execution, or post-session consulting.
The commercial model is pay-per-session.
The price is USD $20 for one paid calculation session, unless a different price is clearly displayed before payment.
One paid session provides access for a 3-hour working session.
The session output is a generated PDF Engineering Estimation Report.
There is no subscription, no physical delivery, no downloadable software product, and no mandatory user account registration.
During a calculation session, the user receives an automated engineering calculation based on the project parameters entered by the user. The output may include:
The Service provides numerical estimates and calculated delivery scenarios. It does not make business decisions for the user.
The user is responsible for the accuracy, completeness, and relevance of all parameters entered into the Service.
The calculated result depends on the user-provided inputs and the current configuration of the calculation model.
The Service does not independently verify the user’s business idea, technical assumptions, market context, internal constraints, or real-world execution capability.
The user remains solely responsible for interpreting the report and for making any business, technical, delivery, staffing, contractual, operational, or resource-allocation decisions.
The Service does not provide financial, investment, legal, tax, HR, psychological, security-screening, due-diligence, valuation, or project-management consulting services.
The word “Polygraph” is a brand metaphor for measurement discipline and clarity. The Service is not a lie detector and does not perform psychological, HR, identity, or security screening.
The Service does not guarantee real-world project success, market success, exact release dates, return on investment, implementation outcomes, team performance, or acceptance by any third party.
The Service calculates estimated engineering effort and delivery scenarios based on user inputs. The final decision belongs to the user.
The Service is designed for use without mandatory user account registration.
The Service does not require the user to submit an email address to perform a calculation session, except where a payment provider or delivery process requires transaction-related information.
User project inputs are processed for the active session and for PDF report generation. The Service is not intended to operate as a long-term project data storage platform.
Operational, security, payment, anti-abuse, and technical logs may be kept where necessary to operate and protect the Service, comply with payment processing requirements, or resolve delivery issues.
The Service does not sell user project data and does not use user project inputs to train AI models.
The Service does not use a SQL or relational database for long-term storage of user project inputs. This design reduces persistent storage of project data and supports session-based processing.
Session input data is cleared upon session expiry or user exit from the calculator.
The Service does not contain AI or machine learning components. The calculation is performed by a fixed deterministic algorithm. The Service does not learn from user inputs.
Payments are processed by third-party payment providers. The Operator does not store card data.
After successful payment, the system issues access to a calculation session. The user should complete the calculation within the 3-hour working session.
The PDF Engineering Estimation Report is delivered as the result of the paid calculation session.
If a technical delivery problem occurs after successful payment, the primary remedy is reasonable re-delivery or restoration of access where technically possible.
Because the Service provides immediate access to an automated digital calculation session, all sales are final once the calculation has been successfully executed and the report has been made available, except as required by mandatory law.
No refund is provided for disagreement with the calculated result, user input errors, a user’s change of plans, missed session time, inactivity, or failure to use the report.
If a paid session cannot be delivered due to a verified technical failure of the Service, the primary remedy is re-delivery, replacement access, or restoration of access. A refund may be considered only if re-delivery or restoration is objectively impossible or required by mandatory law.
The Service may be unavailable, restricted, or suspended due to maintenance, security, payment-provider requirements, legal restrictions, anti-abuse measures, or technical limitations.
The Operator may restrict access from jurisdictions, users, or transactions where payment processing, compliance, security, or operational risks cannot be reasonably managed.
Attempts to bypass technical restrictions, abuse the payment flow, manipulate access tickets, interfere with the Service, or reverse-engineer the calculation flow may result in denial of access.
The user agrees not to use the Service for unlawful purposes, fraud, abuse, automated scraping, security attacks, unauthorized access, reverse engineering, redistribution of the calculation model, or misleading third parties about the nature of the generated report.
The user must not represent the report as a guarantee of real-world delivery, financial outcome, investment result, legal conclusion, or professional consulting opinion.
The user may use the generated report for internal engineering planning, project discussion, scope comparison, delivery scenario evaluation, and communication with project stakeholders, provided that the report is not misrepresented.
The Service, calculation model, methodology, interface, branding, text, software, report structure, and visual presentation are protected intellectual property of Digital Polygraph and/or its author, unless otherwise stated.
The underlying estimation methodology is original and is the subject of a filed invention application in Ukraine.
Payment for a session grants the user a limited, non-exclusive, non-transferable right to use the Service for one calculation session and to use the generated report for the user’s own internal project planning and communication.
No ownership of the Service, software, calculation model, methodology, source code, trademarks, or branding is transferred to the user.
The Service may use third-party infrastructure, hosting, payment providers, security tools, operational monitoring tools, or PDF generation components.
The Operator is not responsible for interruptions, delays, restrictions, or errors caused by third-party payment providers, networks, hosting platforms, browsers, or user devices, except where mandatory law provides otherwise.
The Service is provided “AS IS” and “AS AVAILABLE”.
To the maximum extent permitted by law, the Operator disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
The calculated report is an engineering estimate based on user inputs and the current calculation model. It is not a promise, guarantee, forecast of actual outcome, or professional advisory opinion.
To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages; lost profits; lost opportunities; business interruption; loss of data; or decisions made by the user or third parties based on the report.
The maximum aggregate liability of the Operator for a paid session is limited to the amount paid for that session, except in cases of intentional misconduct, gross negligence, or where mandatory law provides otherwise.
The Operator may update the Service, calculation model, interface, pricing, payment providers, access rules, and these Terms from time to time.
Updated Terms become effective upon publication on the website, unless a different effective date is stated. Continued use of the Service after publication constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Ukraine, unless mandatory applicable law provides otherwise.
Disputes should first be resolved through good-faith communication. For support or dispute-related communication, the user may contact the Operator at: support@effort-clarity.com. If no resolution is reached, disputes are submitted to the competent court at the Operator’s place of registration in Ukraine, unless mandatory applicable law requires otherwise.
